MindShift — Terms of Use

1. The agreement

These terms are between you and Mr Harvey Butters, trading as Winning Beans ("we", "us"). Winning Beans is the trading name of Mr Harvey Butters. Postal address: Fairview, 8 Daffodil Gardens, Walberton, Arundel, West Sussex, BN18 0XQ. ICO registration number: ZC263073. Email: hello@healthnothype.co.uk. By creating an account or using MindShift you accept them. If you do not accept them, please do not use the app.

You must be at least 16 years old to use MindShift.

2. What MindShift is — and what it is not

MindShift is a wellbeing and self-tracking tool. It lets you record your mood and habits, shows you patterns in your own data, and can generate written coaching using AI.

MindShift is not a medical service. Specifically:

• It is not a medical device and is not registered as one.
• It does not diagnose, treat, cure or prevent any condition.
• The AI coaching is not clinical advice and is not written or reviewed by a clinician.
• The correlations it shows you are statistical patterns in your own entries, not proof that one thing causes another.
• It is not a crisis service and is not monitored. Nobody is watching your entries. If you record a very low mood, the app will show you crisis contacts — but no human is alerted.

Never delay seeking medical help because of anything MindShift shows you. If you are struggling, contact your GP, or: Samaritans 116 123, text SHOUT to 85258, NHS 111 mental health option (England, Wales and Scotland), Lifeline 0808 808 8000 (Northern Ireland), or 999 if your life is at risk.

3. Your account

• You are responsible for keeping your sign-in details secure.
• One account per person. Do not share your account.
• Give us accurate information when you sign up.
• You may delete your account at any time in Profile → Privacy & Data.
• We may suspend or close an account that breaks these terms, is used fraudulently, or is used to attack or abuse the service.

4. Your data belongs to you

You own what you write. Your mood entries, notes and habits are yours.

You give us permission to store and process that content only so we can run the app for you — show it back to you, calculate your patterns, and generate your coaching. That permission ends when you delete it or close your account.

We will not sell your content, publish it, or use it to train AI models.

How we handle your data is set out in the Privacy Policy, which forms part of these terms.

5. What MindShift costs

MindShift is free. There is nothing to buy inside it, and no subscription.

• There are no in-app purchases, no prices, no billing and no automatic renewals. We never see or hold card details.
• Usage limits apply to AI coaching and are shown in the app. They exist to keep the service affordable and to prevent abuse. We may change them, and will tell you in the app if we do.
• If a paid tier is ever introduced, it will be sold through Apple's App Store, these terms will be updated before it goes on sale, and nothing you already have will be taken away without telling you first.

6. Fair use

Do not:

• Try to break into, overload, disrupt or reverse-engineer the service.
• Use automated tools to hammer the API or generate coaching in bulk.
• Attempt to get around usage limits, or use someone else's account.
• Use MindShift for anything unlawful, or to harm anyone.
• Deliberately feed the AI content designed to make it behave harmfully.

We may suspend accounts that do these things.

7. Availability

We want MindShift to work, but we do not promise it will always be available or error-free. We may change features, or suspend the service for maintenance. If we ever discontinue MindShift entirely, we will give you reasonable notice and a chance to export your data first.

8. Our responsibility to you

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot legally be limited.

Subject to that:

• MindShift is provided "as is". We do not guarantee that it will improve your mood, your habits or your health.
• We are not liable for indirect or consequential loss, or for any decision you make based on what the app shows you.
• Where we are liable, our total liability to you is limited to the greater of £100 or the amount you have paid us in the 12 months before the claim.

Your legal rights as a consumer are not affected by anything in this section.

9. Changes to these terms

We may update these terms. If a change materially affects you, we will tell you in the app before it takes effect. Continuing to use MindShift after that means you accept the new terms. If you do not accept them, you can delete your account.

10. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you may bring proceedings in your own courts.
